TERMS & CONDITIONS

Because physical exercise can be strenuous and subject to the risk of serious injury, AMG Dance Studio urges you to obtain a physical examination from a doctor before participating in any dancing activity.

You (each student, guest, or participant) agree that if you engage in any physical exercise or dancing activity or use any studio amenity on the premises or off premises including any sponsored studio event, you do so entirely at your own risk. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.

 

This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment, (c) our instruction, training, or supervision, and (d) your slipping and/or falling while in the studio, or on the studio premises, including adjacent sidewalks and parking areas.

 

You acknowledge that you have carefully read this "waiver and release" and fully understand that it is a release of liability. You irrevocably and unconditionally expressly agree to release and discharge the health club, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the club for negligence, personal injury or property damage. You further agree to indemnify and hold harmless each of AMG Dance Studio, its members, managers, owners, employees, and agents harmless from and against all loss, claim, damage, liability, cost, or expense arising from any action, claim or proceeding brought against any of them by any guest or family member using AMG Dance Studio's facilities, either with or without your consent, knowledge, or supervision.

 

You further acknowledge and agree that neither party shall be liable to the other party for any special, indirect, incidental, or consequential damages arising out of this Agreement. Except as otherwise specifically set forth herein, AMG Dance Studio's total liability to you under or in connection to this Agreement shall not exceed the amounts paid or payable to AMG Dance Studio hereunder; provided however, that the foregoing limitation of liability shall not apply to the willful misconduct of AMG Dance Studio. Any action against AMG Dance Studio arising out of, resulting from, or related to the performance or breach of this Agreement shall be filed not later than three (3) months after the cause of action has accrued.

 

Lost and Found: AMG Dance Studio is not responsible for personal items lost or left at the Studio. Any items found at AMG Dance Studio will be kept for thirty (30) days and then donated or discarded.

 

Valuables: For your protection, do not bring valuables into AMG Dance Studio. AMG Dance Studio is not responsible for or liable to Members for damaged, lost, or stolen items.

 

Damages: The student shall pay for any damage to AMG Dance Studio's property by the Student, Student’s guest, or dependent children.

 

Injury or Incident: Any Student or guest injuries or accidents must be reported immediately to the Instructor and Manager. An Incident report will be completed and filed.

 

Cell Phone Usage: Out of respect for Instructors, other Members and their class experience, please refrain from cell phone use while at dancing class.

 

Recording: No videos, records or photos shall be taken absent previous approval of the Studio.

 

Attire: For safety and hygiene reasons, Students must wear proper athletic attire, including shirt, pants/ shorts, and footwear (no sandals, flip-flops or bare feet are permitted) during a dancing class.

 

Notification: Students must notify the instructor of the dancing class for any late arrival, early leaving, or absence prior to the class time.

 

Hours of Operation: AMG Dance Studio hours are posted on the premises. These times are subject to reasonable adjustments and may be changed for holidays or maintenance purposes at the discretion of AMG Dance Studio management.

 

Permission for Use: Student success is acknowledged and celebrated through the sharing of Student results, photos, and personal success story submissions through E-mail or online chat. Student grants AMG Dance Studio permission for use of such stories and photos using distribution methods including, but not limited to, website, social media sites, newsletters/blogs, and marketing materials unless Student chooses to opt out of such permission for use.

 

Should any part of this agreement be found by a court of law to be against public policy or in violation of any state statute or case precedence, then the remainder of this document will remain in full force.
